Notice of Deadline for Comments and Other Petitions for Intervention (CN 9773)

Case Decisions |

On October 7, 2025,1 PSEG Renewable Transmission LLC (“PSEG,” the “Company” or the “Applicant”) filed a Response noting the Company’s objection to Commission Order No. 91825 (the “Procedural Order”). Subsequently, on October 28, 2025, The Maryland Farm Bureau, et al.; Carroll County, Maryland; Dell Generation Farms, LLC, et al.; and Lippy Brothers Farms and Stop MPRP, et al., (collectively, the “Maryland Farm Bureau”) filed a Motion with the Commission to dismiss PSEG’s Application for Certificate of Public Convenience and Necessity (“CPCN”). On November 14, 2025, PSEG filed a Memorandum in Opposition to Motion to Dismiss Application for CPCN, stating that the Procedural Order affords the parties the opportunity to address issues in discovery and testimony for the Commission’s consideration at the evidentiary hearings and in briefs. The filing further requests that the Commission deny the Motion to Dismiss the Application.

Also, on November 14, 2025, PSEG filed with the Commission a Routing Update which contained certain adjustments made to the proposed right-of-way (“ROW”) for the MPRP. The Company identified 11 adjustments to the ROW for consideration with the CPCN application and states these adjustments are isolated modifications that do not change the overall route of the MPRP. The Company requests that the Commission issue a notice allowing the landowners impacted by the routing adjustments to file a Petition to Intervene.

Accordingly, the Commission hereby gives Notice that the deadline for Petitions to Intervene by landowners affected by the updated routing adjustments identified in PSEG’s Routing Update, further comments regarding the Maryland Farm Bureau’s Motion to Dismiss, and PSEG’s Opposition shall be filed within 10 days from the date of this Notice. All comments and Petitions to Intervene shall be e-Filed with the Commission’s Executive Secretary, Andrew S. Johnston, William Donald Schaefer Tower, 6 St. Paul Street, 16th Floor, Baltimore, Maryland 21202, and must reference “Case No. 9773” in the subject line.

Upon receipt of these comments, the Commission will consider the matters discussed herein.

By Direction of the Commission,
Andrew S. Johnston
Executive Secretary
